COLIN H. LUKE is the Chairman of the Firm's Business Law Section. He advises clients with respect to a variety of healthcare and general corporate matters, including asset and stock acquisitions, joint ventures, hospital/physician relationships, provider and payor certification, facility licensure and certificates of need. In addition, Mr. Luke regularly counsels clients regarding HIPAA, corporate compliance and both federal and state healthcare laws and regulations. Colin currently serves as the Chairman of the Alabama Bar's Health Law Section. Mr. Luke has been named "Best of the Bar" for his health law practice by the Birmingham Business Journal and is listed in Best Lawyers in America.
Mr. Luke is also active in the community. He is a Founding Board Member and Past President of the Board of the Birmingham Zoo and a Past President of the Alumni Association for The Altamont School and has served on the Board of Trustees. Mr. Luke currently serves on the Board of Oasis, a Women's Counseling Center, and the Corporate Partners Counsel of the Birmingham Museum of Art and the board of Center Management, Inc. He is a past Vice-Chairman of the Jefferson County Republican Executive Committee and member of the State and County Executive Committees of the Alabama Republican Party. He has regularly advised Republican state and federal candidates and their campaigns. Mr. Luke was named by the Birmingham Business Journal as a member of its "Top 40 Under 40" 2000. He is also a member of the Birmingham Rotary Club.
Mr. Luke has recently served as the senior counsel for a series of acute care hospital divestitures for national healthcare companies. He has also represented a public health care authority in the re-purchase of a large rural acute care hospital from a regional not-for-profit healthcare system. In addition, he counseled a regional for-profit operator of acute care hospitals and senior living facilities in the acquisition of a rural acute care hospital and a number of facilities in several states. He has also been active in the sale of a number of multi-specialty and single-specialty ambulatory surgery centers. Furthermore, Mr. Luke has helped structure a number of joint ventures involving ancillary healthcare services from both the physician and the hospital perspectives. He has obtained Certificates of Need and Letters of Non-Reviewability on behalf of healthcare clients in three different states for a variety of facilities. Mr. Luke has also drafted compliance plans for multi-facility health care organizations.
Prior to joining Balch & Bingham, Mr. Luke served as Vice President and Corporate Counsel for Active Services Corporation, one of the Nation's largest providers of adult day healthcare and home and community-based services. During his tenure with Active Services, Mr. Luke managed the acquisition and development of a number of healthcare facilities and oversaw the company's regulatory and governmental relations efforts. He was responsible for obtaining certificates of need for the company's facilities in several states. Mr. Luke has extensive experience with managed care contracting as well as Medicare and Medicaid reimbursement issues.
