Electronic Discovery and Data Management

Balch’s Electronic Discovery and Data Management Group works with clients to navigate corporate document retention issues and to develop and implement strategies for managing all stages of electronic discovery and retention and spoliation (evidence destruction) detection.

Balch’s Data Management Team has experience in developing and updating electronically stored information (ESI) data retention policies and procedures, including backup, archiving and destruction to enable e-Discovery readiness and compliance, as well as investigating hacking, inappropriate use of company computers and computer aspects of internal investigations. Our lawyers frequently advise clients and work together with them to manage data preservation, explore the nature and extent of hacking and computer fraud and abuse, review strategies and third-party vendor selection while controlling costs.

The Electronic Discovery Team regularly works with litigation teams, including attorneys from other law firms, to move ESI through the discovery process. From the earliest stages of litigation, our lawyers initiate and implement litigation holds, analyze e-Discovery issues (including cost), respond to pre-litigation preservation matters, develop key search terms and techniques and assist in responding to discovery requests. We offer guidance and support in preserving, identifying, collecting, filtering and producing ESI. Our lawyers also advise and counsel clients on matters related to compliance and risk assessments, as well as spoliation and sanction issues.

Balch’s Electronic Discovery and Data Management Group also educates firm attorneys and in-house counsel on e-Discovery procedures and trends. The members of our team are active at the national and state levels on numerous electronic discovery committees.
