NERC Submits Three Notices of Penalty to FERC


March 31, 2009
On March 31, 2009, NERC submitted the following three NOPs to FERC.

(1)  NERC provided notice of Dynergy, Inc.’s penalty associated with its two self-reports of possible violations of Reliability Standard VAR-002-1, R2, for failure to maintain the hourly integrated voltage value of the specified unit with the voltage specified by the TOP for the relevant hour.  Dynergy does not dispute the violation or the proposed penalty of $0.  To view the Dynergy NOP, click here.
 
(2)  NERC provided notice of Black River Generation, LLC’s penalty regarding Black River’s self-certified non-compliance with Reliability Standard PRC-005-1, R1.  Black River does not dispute the violation or the proposed penalty of $0.  To view the Black River NOP, click here.

(3)  NERC provided notice of FPL Energy (now known as NextEra Energy Resources, LLC) penalty of $250,000 for alleged violations of Reliability Standard PRC-005-1,  R1 and R2, and CIP-001-1, R1 and R2.  To view the FPL NOP, click here.
