JEREMY L. RETHERFORD serves as Chairman of the firm's hiring and recruiting committees. Jeremy is a memeber of the Firm's Creditors Rights and Bankruptcy Practice Group and has devoted the length of his entire practice to representing financial institutions and other creditors. Jeremy routinely represents creditors in out of court workouts as well as in enforcing rights and remedies outside of court (e.g., non-judicial foreclosure). Jeremy also represents creditors in state and federal litigation whether it be enforcing rights and remedies of his clients or defending claims asserted against his clients. Jeremy has significant experience in representing creditors in bankruptcy cases and adversary proceedings (e.g., debtor-in-possession financing, cash collateral disputes, claims objections and chapter 11 plan confirmation proceedings). Jeremy also has significant experience in receivership actions both in representing creditors seeking the appointment of a receiver and in the representation of the receiver itself. Jeremy routinely represents financial institutions in the management and sale of real property acquired through foreclosure or similar means. He also routinely represents commercial landlords in landlord-tenant disputes as well as construction contractors and sub-contractors in the perfection and enforcement of materialmen and mechanics liens.

Jeremy and his wife, Lora, were married in 2005. They have three children. The Retherford family also includes a Golden Retriever (“Cash”) and a Chocolate Lab (“Scout”).


REPRESENTATIVE EXPERIENCE

  • Represent creditor in federal district court seeking to avoid fraudulent transfers and piercing of the corporate veil.
  • Represent creditor in adversary proceeding seeking to have debt deemed nondischargeable under federal bankruptcy law. 
  • Represent creditor in adversary proceeding in which debtor alleged violation of the automatic stay and wrongful repossession. 
  • Represent judgment creditors in the enforcement of judgments by sale of assets by sheriff and the U.S. Marshal. 
  • Represent financial institutions in obtaining relief from the automatic stay to commence foreclosure of real property collateral. 
  • Represent lender in chapter 11 DIP financing transaction. 
  • Represent creditors in defense of preference actions in federal bankruptcy cases. 
  • Represent financial institution in the sale of distressed loans. 
  • Represent financial institution in the management and sale of ORE real estate.
