Leslie Garrett Allen is partner in the Birmingham office and a member of the Environmental and Natural Resources and Nuclear Energy Practice Groups. Ms. Allen specializes in regulatory compliance under the Clean Air Act (“CAA”) and the National Environmental Policy Act (“NEPA”). Ms. Allen’s CAA experience includes:

  • obtaining, amending, and transferring state and federal PSD/NSR/Title V permits
  • advising utilities on implications of New Source Review
  • responding to CAA § 114 requests
  • representing permittees in state administrative proceedings
  • preparing comments on proposed rules
  • planning for and compliance with Maximum Achievable Control Technology (“MACT”) standards.

Her NEPA experience includes:

  • involvement in preparation of an Environmental Impact Statement (“EIS”) for applicant for funding under DOE’s Clean Coal Power Initiative
  • representing applicant for federal funding in challenge to agency’s NEPA analysis
  • preparing comments on CEQ guidance
  • advising third party applicants in NEPA process with federal agencies.

Ms. Allen’s work in the Nuclear Energy section involves representation of an applicant for an Early Site Permit (“ESP”) and Combined Operating License (“COL”) from the Nuclear Regulatory Commission (“NRC”). She has participated in the contested and mandatory hearings with respect to issues arising under NEPA. Ms. Allen also advises on environmental issues related to nuclear energy.

In addition to her CAA and NEPA experience, Ms. Allen has experience in all federal and state environmental matters, including those arising under the Clean Water Act, state water law, and CERCLA.
