LOIS SMITH WOODWARD is a Partner in the firm’s Birmingham office. She specializes in advising clients who offer products and services to consumers and small businesses. Among her clients are businesses in a variety of industries, including banks and other financial institutions, utilities and motor vehicle dealerships. She is a member of the firm's Credit Crisis Group, a special team of lawyers working on challenges created by the current disruptions in the credit and other capital markets.
Ms. Woodward has extensive experience in the following areas: - Documentation of and disclosures required for consumer financial transactions, including credit cards, debit cards, and stored value cards; home equity line agreements and other residential mortgage loan documents; loan agreements; installment sales contracts; and consumer leases
- Payment systems regulation, compliance and dispute resolution (including credit cards, debit cards, stored value cards, automated clearinghouse transfers, and electronic bill presentment and payment)
- Structuring and documenting creditors’ relationships with vendors, service providers, affiliates and marketing partners, including relationships subject to the Real Estate Settlement Procedures Act (RESPA)
- Use of customer information, including the establishment and implementation of privacy and security policies
- E-commerce, including electronic contracting and disclosures
- Insurance agency regulation and compliance
- Banking and financial services litigation
- Privacy regulation and compliance
- Warranty and service contract regulation and compliance
- Review of promotional and advertising materials, including websites, direct mail pieces, telemarketing scripts and other media
