Richard E. Glaze, partner in the firm’s Atlanta office and member of the Environmental & Natural Resources Section, authored an article for Law 360 on May 6, 2015, that serves as a guide for managing enforcement risks associated with EPA and OSHA Risk Management Plan (RMP) requirements. Facilities that use certain quantities of “extremely hazardous substances” are required by Section 112(r) of the Clean Air Act to maintain a detailed RMP and comply with related regulations. Increased enforcement by EPA has enhanced the risk of RMP inspections by EPA and delegated states.
