Steven A. Burns, partner in the firm’s Birmingham, Ala., office and member of the Environmental & Natural Resources Section, was quoted by Law 360 on July 24, 2015, regarding five Resource Conservation and Recovery Act (RCRA) cases to watch. Mr. Burns spoke specifically on judicial challenges to regulations of the Environmental Protection Agency (EPA) for coal combustion residuals, or CCR. Mr. Burns commented that he expects industry to challenge the CCR rule regarding the regulation of inactive facilities and CCR intended for recycling rather than disposal. He also noted that the current rule does not provide for risk-based responses in some important instances.
