  • What type of matters do you work on most often?

    Licensing actions and licensing basis compliance issues for commercial nuclear plant owners and operators before the NRC are the most common matters I work on. These matters can range from advice related to applications such as license amendments or exemptions, to preparing pleadings in contested proceedings and participating in oral argument. Ongoing compliance questions arise for both nuclear plants under construction and existing operating plants, and I provide assistance in regulatory analysis and interpretation. My practice also includes contractual disputes, usually with respect to the EPC Agreement for new nuclear plants under construction, but also related to coal purchase agreements.

  • New nuclear plant licensing: Represented the plant owners and operator in early site permit and combined license proceedings before the NRC. Participated in contested adjudications and related appeals before the D.C. Circuit. Also represented the plant owners and operator in the first-ever uncontested hearing on a combined license before the NRC.
  • Contested license amendments: Represented the plant owners and operator in challenges to license amendment applications before the NRC. Represented the plant owners and operator at the first oral argument before the NRC Atomic Safety and Licensing Board on a challenge to a license amendment application for a combined license.
  • EPC agreement negotiation and administration: Represented the plant owners in the negotiation of amendments to the EPC Agreement for two new nuclear units. Provided assistance with respect to the administration of Change Order claims and analysis of indemnification, audit and oversight, and invoicing provisions.
  • EPC agreement Litigation: Represented the plant owners in litigation arising under the EPC Agreement for two new nuclear units. Assisted the plant owners with the negotiation of a related settlement agreement.
  • New nuclear compliance: Advised nuclear plant operator regarding compliance during construction, including emerging issues identified during construction, license amendment requests, exemptions, and regulatory approvals.
  • Specific authorization under 10 CFR part 810: Successfully represented the nuclear operator in a request for specific authorization for a foreign transfer of nuclear information. Assisted in the preparation of the request, responses to requests for additional information and related reporting requirements.
  • Coal purchase agreement: Represented the utility with respect to the negotiation and drafting of a multi-year coal purchase agreement. Continue to assist with the administration of the agreement, including amendments and pricing changes.
  • License transfer applications: Represented the potential purchaser in development of a license transfer application for the NRC to support its planned acquisition of an entity with nuclear units. Represented the nuclear plant operator with respect to a COL license transfer application.
