Peter D. LeJeune is a Partner in the Firm’s Energy Practice Group. His practice focuses on the representation of owners, operators, and purchasers of nuclear power plants, in energy transactions, regulatory matters, and new plant development. Peter also has extensive experience with regard to government contract matters both at the state and federal levels.  Prior to joining the Firm, Peter practiced in Washington, D.C. where his practice focused on administrative litigation and regulatory matters primarily before the Federal Energy Regulatory Commission, the Nuclear Regulatory Commission, and the Department of Energy.

Representative Experience

    • Representation of owners with regard to the development of new nuclear generating facilities, including licensing matters and drafting and negotiation of related engineering, procurement and construction agreements, operating agreements, and project development agreements.
    • Representation of developer of new nuclear power plant in connection with its applications for federal incentives under the Department of Energy’s Loan Guarantee and Standby Support programs.
    • Representation of electric utility with regard to government contract compliance matters stemming from Stimulus Act grant programs, including Smart Grid grants.
    • Representation of purchasers in two unit nuclear generating facility, including counsel during due diligence process, advice concerning transaction structure, and preparation of license transfer application.
    • Representation of potential bidder on nuclear facility in due diligence process, license transfer issues, and transaction structure.
    • Representation of purchasers and sellers in various purchase power agreements for capacity and energy from fossil and nuclear generating units.
    • Representation of purchasers of fossil fuel generating facilities in due diligence process and development of transaction documentation.
    • Representation of utility in FERC Section 206 investigation as well as other FERC regulatory proceedings with regard to compliance with the Standards of Conduct and Code of Conduct.
    • Representation of utility with regard to issues arising from a cooperative agreement with the Department of Energy related to research and development of alternative electric generating resources.
    • Representation of technology firms with regard to nuclear regulatory compliance and nuclear export licensing requirements.
    • Representation of entities with regard to state competitive bid law issues, protests, and contract negotiations.
    • Representation of companies with regard to negotiations of GSA MAS contracts and associated compliance matters.
    • Represented client with regard to a US Corp of Engineers request for proposals related to reconstruction of the oil infrastructure in Iraq.
    • Represented client on insurance and indemnity issues stemming from USAID contract to provide operational and administrative services for the seaport in Umm Qaser, Iraq.
    • Representation client with negotiation of a sole-source contract with the Department of Defense to provide irradiation technology and equipment for use in decontamination of various items.
