FERC Issues Order on Duke Notice of Penalty

On January 16, 2009, FERC issued a notice announcing that it will not conduct further review of the notice of penalty (NOP) NERC filed with the Commission on December 19, 2008 regarding Duke Energy Carolinas, LLC.  The NOP concerned Duke’s August 27, 2007, self-report of an outage of a 230 kV transmission line possibly caused by a flashover between vegetation located inside the right-of-way and overhead ungrounded supply conductors, which SERC determined to be evidence of an alleged violation of FAC-003 Requirement 2.  To view FERC’s order, click here.
