FERC Issues Order No. 706-B Clarifying Applicability of CIP Reliability Standards to Nuclear Facilities

On March 19, 2009, FERC issued Order No. 706-B in order to clarify the scope of the Critical Infrastructure (CIP) Reliability Standards approved in Order Nos. 706 and 706-A.  Specifically, FERC explains that each of the CIP Reliability Standards exempts facilities regulated by the NRC from their requirements.  However, it has come to the Commission's attention that NRC regulations do not extend to all equipment within a nuclear power plant.  Thus, to assure that there is no regulatory “gap” with respect to such equipment not governed by NRC regulations, the Commission clarifies that the “balance of plant” equipment within a nuclear power plant that is not regulated by the NRC is subject to compliance with the CIP Reliability Standards approved in Order Nos. 706 and 706-A.  To read the entire FERC Order No. 706-B, click here.
