NERC Submits Proposed Amendments to Rules of Procedure relating to CIP Technical Feasibility Exceptions

On October 29, 2009, NERC submitted a petition to FERC seeking approval of amendments to its Rules of Procedure (ROP).  NERC’s proposed amendments will add to the ROP (1) new Section 412, “Requests for Technical Feasibility Exceptions to NERC Critical Infrastructure Protection Reliability Standards”; and, (2) new Appendix 4D, “Procedure for Requesting and Receiving Technical Feasibility Exceptions to NERC Critical Infrastructure Protection Standards.”  NERC explains that these amendments are intended to implement the Commission directive in Order No. 706 that NERC develop and adopt a set of conditions and criteria that a responsible entity must follow when relying on the “technical feasibility exception” contained in specific Requirements of certain CIP Reliability Standards.  NERC explains that proposed section 412 and Appendix 4C were approved by the NERC Board of Trustees on October 16, 2009.  To view NERC’s petition, click here.
