FERC Approves Settlement Agreement for PacifiCorp

On December 1, 2011, in Docket No. IN11-6, FERC approved a stipulation and consent agreement between FERC’s Office of Enforcement, NERC, and PacifiCorp as a result of a joint investigation by FERC and NERC into the possible violations of NERC reliability Stdnards by PacifiCorp related to its functions as a Balancing Authority and Transmission Operator surrounding a disturbance that originated in Utah on February 14, 2008. In addition to a set of Reliability Enhancement Measures and semi-annual compliance reports to FERC and NERC staff for up to two years, the agreement also stipulates to a penalty of $3,925,000, to be allocated equally between the U.S. Treasury and NERC.
