Northeastern States Challenge NRC Continued Storage Rule in the D.C. Circuit

Attorneys general from New York, Connecticut, and Vermont have filed a petition in the D.C. Circuit for review of the NRC’s Continue Storage Rule. The Rule and accompanying Environmental Impact Statement (EIS), which were issued on September 19, 2014, relate to storage of spent nuclear fuel onsite at nuclear reactor facilities and offsite at a waste repository. The petition argues that the NRC’s Rule and EIS do not comply with NEPA and the Atomic Energy Act, and urges the D.C. Circuit to vacate the Rule.
