DOE Proposes New Nuclear Damage Cleanup Regulations

The DOE has issued a Notice of Proposed Rulemaking to create new regulations under the Energy Independence and Security Act to establish a nuclear cleanup fund for incidents not covered by the Price-Anderson Act.  The proposed rule would require domestic nuclear suppliers to match the United States’ contributions to an international nuclear damage compensation fund under the Convention on Supplementary Compensation for Nuclear Damage.  Nuclear suppliers would only be required to pay into the pool in the event of a qualifying international nuclear incident.  The DOE’s proposed rule contains two alternative formulas for calculating each supplier’s contributions.  The DOE is holding a meeting to discuss the proposed rule on January 7, 2015.  Comments are due by March 17, 2015.
