NRC Updates Enforcement Policy to Expand Alternative Dispute Resolution Program

The NRC has issued a revision to its Enforcement Policy to include escalated non-willful enforcement cases with potential civil penalties within the Alternative Dispute Resolution (ADR) Program. In 2010, the Commission directed the NRC staff to review the ADR program and to evaluate whether the program should be expanded. In 2012, the staff conducted a one-year pilot program to make ADR available for escalated non-willful enforcement cases with potential civil penalties. Following this pilot program, the staff recommended that the Commission expand the ADR program to include such cases, which the Commission approved. Accordingly, the NRC is revising Section 2.4.3 of the Enforcement Policy to implement this change.
