Kauffman, partner in the firm’s Birmingham, Ala., office and member of the Labor & Employment Section, was quoted by Human Resource Executive on June 15, 2015, regarding Fair Credit Reporting Act (FCRA) requirements and violations. Mr. Kauffman advised on precautionary measures employers can take to avoid violating FCRA requirements. Mr. Kauffman emphasized the importance of the review of FCRA requirements in order to ensure all forms and notification processes are FCRA compliant. When dealing with third parties, such as staffing agencies, Mr. Kauffman discussed the importance of negotiating a FCRA compliant contract and ensuring the employer is not to blame if the vendor violates FCRA requirements.
