Jason Tompkins, partner, and Chase Espy, attorney, both in the firm’s Birmingham office and members of the Litigation Practice, addressed the Birmingham Bar Association’s Bankruptcy/Commercial Law Section on August 18, 2017, regarding the landmark U.S. Supreme Court decision in Midland Funding v. Johnson. On August 24, 2017, Jason presented at a South Carolina Bankruptcy Law Association meeting regarding Midland Funding and other key bankruptcy decisions.
Jason and Chase recently created a circuit split that culminated in a victory for Midland Funding before the U.S. Supreme Court in Midland Funding v. Johnson, a case regarding application of the FDCPA to bankruptcy claims. The decision resolved a potential conflict between the FDCPA and the Bankruptcy Code, and could affect other FDCPA cases outside the realm of bankruptcy law.
