Greg Cook and Jonathan Hoffmann Authored Article Regarding TCPA Litigation for National Mortgage News
Greg Cook, partner in the firm’s Birmingham office and chair of the Banking & Financial Services Litigation Practice, and Jonathan Hoffmann, attorney in the firm’s Birmingham office and member of the Creditors Rights & Bankruptcy Practice, authored an article on litigation related to the Telephone Consumer Protection Act (TCPA) on November 30, 2017, for National Mortgage News. The article discusses recent litigation, particularly matters concerning consent, and how it affects financial institutions serving consumers. The TCPA regulates how businesses can communicate with customers, and restricts businesses from using autodialers to call or text individuals' cell phones without proper consent. In the article, Greg and Jonathan discussed why mortgage servicers should be concerned in the recent rise in TCPA litigation and explained the critical need for mortgage servicers to understand in detail how and if consent was captured or revoked.
Greg has deep experience in mortgage servicing litigation, handling more than 250 matters for mortgage servicers and banks – including TCPA claims. A substantial portion of Jonathan’s practice focuses on consumer and financial services litigation, including individual and class action lawsuits under the TCPA.
