Jeremy Retherford Presented on Bankruptcy Litigation at the Mississippi Bankruptcy Conference

Jeremy Retherford, partner in the firm’s Birmingham office and chair of the Creditors Rights & Bankruptcy Practice presented on issues arising out of violations of the automatic stay in bankruptcy at the annual Mississippi Bankruptcy Conference November 8, 2018, in Biloxi, Mississippi.

Jeremy discussed the damages arising out of violations of the automatic stay including payment of attorneys’ fees under the Bankruptcy Code, in light of recent rulings.He offered key takeaways for attorneys to consider when faced with a dispute of this nature, including determining the extent of damages and working with clients to resolve stay violation disputes.

As chair of Balch’s Creditors Rights & Bankruptcy Practice, Jeremy represents financial institutions, utilities, and other creditors faced with troubled credit. He has more than 15 years of experience working with clients at all stages of bankruptcy. Jeremy was recently appointed by Chief Justice John Roberts to serve on the Judicial Conference Advisory Committee on Bankruptcy Rules to the Judicial Conference of the United States, a national policy-making body which shapes bankruptcy procedure and policies.
