  • What types of clients do you represent?

    I represent banks, landlords, mortgage servicers, title insurance companies, judgment creditors, businesses, and real estate developers in a variety of litigation, bankruptcy, and transactional matters.

  • What type of matters do you work on most often?

    Most of the matters I handle involve real estate or financing issues, rights of creditors, landlord-tenant disputes, and collection and enforcement of judgments or other liens. I negotiate and draft complex transactions and I litigate in federal, state, bankruptcy, and probate courts. Typically I represent creditors when problems arise with loans, real estate collateral, or priority disputes involving UCC and other types of collateral. I also resolve title issues for property owners and title insurance companies when mortgages or deeds are defective or when property is sold for delinquent taxes.

Select Matters

  • Condominium development: Represented real estate developer in preparation of condominium declaration and offering statement for new condominium in Alabama. (2016) 
  • Landlord-tenant bankruptcy litigation: Represented owner of New York City office space in litigation with commercial tenant in chapter 11 bankruptcy. (2016)
  • Mortgage servicer bankruptcy litigation:  Represented mortgage servicer in fraud lawsuit filed by borrower; removed to bankruptcy court and dismissed with prejudice. (2015-2016)
  • Tax sale litigation: Represent national bank in litigation and appeals by tax purchaser asserting rights under the Alabama Code. (2015-2016)
  • Lender liability litigation: Represented national bank in collection of a defaulted loan and defense of counterclaims for wrongful foreclosure and fraud; arbitrated before the AAA and confirmed by the United States District Court for the Northern District of Alabama. (2014-2015)
  • Litigation of waivers in forbearance agreements: Represented state bank in litigation with borrower and individual guarantors challenging the enforceability of waivers of defenses and counterclaims in forbearance agreement; affirmed by the United States Court of Appeals for the Eleventh Circuit. (2011)
  • Commercial loan defaults: Routinely represents banks in the workout and restructuring of defaulted commercial loans.
  • Enforcement of judgments: Enforces judgments on behalf of creditors through garnishments, post-judgments proceedings, and sales of real and personal property.
