    I represent commercial clients ranging from Fortune 500 companies, including a number of national banks and financial institutions, title insurers and other insurance carriers, transportation common carriers, and other corporations operating in the hospitality, medical, and multi-media industries, to other corporate business lines, including regional and local banks and financial services companies, nationwide and regional franchisers enforcing non-competition covenants and other franchise rights and obligations, and special purpose real estate entities in complex mortgage and lease related cases, to various small businesses and individuals with localized litigation disputes.

  • Obtained published opinion by the Eleventh Circuit Court of Appeals affirming Summary Judgment by Southern District of Georgia federal court as to trio of cases brought by landowners against Fortune 500 railroad client and confirming Interstate Commerce Commission Termination Act, 49 U.S.C. section 10501(b), preempts state law tort remedies as applied to railroad’s side track operations.  (Pace v. CSX Transportation, Inc., 613 F. 3d 1066 (11th Cir. 2010))
  • Obtained significant dismissal of international dispute brought in Florida federal district court for Japanese company on forum non conveniens grounds and requiring plaintiff manufacturing company to bring its action in Japan. (J.C. Renfroe & Sons, Inc. v. Renfroe Japan Co., Ltd., 515 F.Supp.2d 1258 (M.D. Fla. 2007))
  • Obtained significant case-impacting order for major surgical products manufacturing client denying competitor’s summary judgment motions in complex case alleging patent infringement and detailing substantial legal findings and conclusions on United States patent law. (Medtronic Xomed, Inc. v. Gyrus ENT, LLC, 440 F.Supp.2d 1333 (M.D. Fla. 2006))
  • Obtained significant affirmance for international banking trust client of trial court order denying motion to vacate final judgment of mortgage foreclosure confirming Florida procedural rules concerning standing to enforce promissory note and mortgage.  (Dage v. Deutsche Bank Nat’l Trust Co., 95 So. 3d 1021 (Fla. 2d DCA 2012))
  • Obtained rare order granting motion for rehearing of appellate decision to correct initial decision in foreclosure action that would have had devastating and wide-ranging ramifications to pending Florida foreclosure actions statewide and to the Florida evidence code pertaining to the business records exception to the hearsay rule if not corrected by appellate court on rehearing. (Glarum v. LaSalle Bank, N.A. n/k/a Bank of America, N.A., 83 So. 3d 780 (Fla. 4th DCA 2011))
  • Obtained appellate opinion reversing trial court’s Summary Judgment order and affirming essential contract principles of acceptance and revocation in million dollar breach of contract action brought by GE subsidiary against vendor of airport scanning and imaging systems. (GE FANUC, Inc. v. Brijot Imaging Sys., Inc., 51 So. 3d 1243 (Fla. 5th DCA 2011))
  • Obtained rare appellate order granting writ of certiorari as to trial court order on discovery in putative shareholder class action case establishing and confirming precedent under Florida law and procedure that class action plaintiff is not entitled to merits discovery unless and until putative class is certified by the court.  (Policastro v. Stelk, 780 So. 2d 989 (Fla. 1st DCA 2001))
