ARMIN J. MOELLER, JR. is a Partner in the Labor and Employment group in the Jackson office. His practice concentrates on labor relations and employment law issues, but includes litigation, arbitration and drafting and negotiating contracts. Mr. Moeller represents employers in maintaining non-union status; collective bargaining negotiations and arbitration; race, sex, religion, age, disability, sexual/workplace harassment discrimination and retaliation claims; handling EEOC, NLRB, OSHA and other agency claims through judicial process; drafting employment severance, noncompetition and confidentiality contracts; and affirmative action and OFCCP compliance. He also counsels employers concerning human resources issues and conducts client training programs. Mr. Moeller has negotiated information technology project agreements with leading technology companies and has litigated claims against information technology companies.

Representative Experience

    • Received a $25,000 attorneys' fees award for medical center as the prevailing defendant against a former laboratory director
    • Defeated workers compensation and race discrimination claims on basis an employee's hanging was result of his own prank; defeated state court action on his subsequent termination claim
    • Defeated race and First Amendment claims by an Asst. Dir. of Nursing and persuaded court to award sanctions
    • Removed an engineering/manufacturing facility from UAW master auto agreement and negotiated a 60% reduction in wage rates
    • Compelled six female employees to arbitrate multi-million dollar claims against Fortune 500 company about installation of one way mirror in their restroom; claimants awarded only $500
    • Compelled arbitration of four employees' claims of sex discrimination, hostile work environment and retaliation against Fortune 100 company and prevailed on all claims in arbitration
    • Represented Fortune 100 company in arbitration of claims of race, sex and hostile work environment discrimination and retaliation; arbitrator dismissed all claims and required claimant to pay one-half of all arbitration costs
    • Advised construction clients in establishing union and non-union companies and drafted union project agreements throughout the United States
    • Received defense jury verdict on race/sex claims by Assistant State Superintendent of Education
      Defeated unionization efforts among employees in industries including packaging, food service, aerospace, healthcare, wastewater treatment, construction, processing and marine service
    • Successfully resolved two ADA epileptic seizure cases for a major manufacturer
    • Analyzed legal issues relating to Fortune 100 company=s race and gender pay equity plan.
    • Represented Fortune 500 company in terminating two employees for strike misconduct; prevailed in two separate arbitrations and an unfair labor practice proceeding
    • Developed ADR programs including binding arbitration for several companies
    • Negotiates collective bargaining agreements for several manufacturing companies
    • Arbitrator found just cause for discharge of long term employee for suspected sexual harassment although Company's evidence was circumstantial
    • Arbitrator upheld discharge of coworker for assault, although evidence was circumstantial
      Prepared recruitment, screening and hiring policies for nonunion construction employers and trained management personnel to avoid unfair labor practice charges and maintain nonunion status.
    • Prepared and conducted executive counseling programs for individuals found responsible for inappropriate conduct and/or management/leadership deficiencies
    • Prepared and conducted training programs for management personnel addressing harassment and/or misconduct investigations; sex, age, race and disability harassment problems
    • Prepared and conducted management training programs addressing effective communications with employees
    • Prepared and conducted training programs to address early warning signs of union activity, lawful communications with employees concerning union activity and to dissuade employees from interest in unions

    Contracts and Information Technology Litigation

    • Lead counsel for the State of Mississippi in terminating an information technology software/integrated systems contract and filing suit for compensatory and punitive damages; jury awarded $474,534,692.00
    • Successfully settled case five days later for $185,000,000
    • Negotiated information technology project agreements with leading technology companies for state agencies
    • Negotiated healthcare claims administrative services contract with leading healthcare provider covering over 80,000 public employees
