Developing Law of Clinical Integration: FTC Staff Opinions Involving MedSouth, Inc. & Greater Rochester Independent Practice Association, Inc.
This article focused upon the then relatively new antitrust advice being given by the Federal Trade Commission (FTC) with regard to clinical integration. In sum, the article discussed the legal standard announced by the FTC for determining whether sufficient clinical integration has occurred in order to allow physicians to not only agree on their fees but also collectively negotiate price terms with health insurance payers without running afoul of the antitrust laws that generally would prohibit such behavior.
