FERC Affirms Penalty Against NextEra Resources

On March 19, 2015, in Docket No. NP15-1, FERC issued an order affirming a $52,000 penalty assessed by NERC against NextEra Resources for failure to comply with an out of merit instruction issued by the Electric Reliability Council of Texas (ERCOT). The Commission agreed with NERC that NextEra failed to comply with an out of merit instruction that NextEra reduce the output of one of its wind generation stations, and that NextEra’s failure to comply constituted a violation of Reliability Standards IRO-001-1 Requirement R8 and TOP-001-1 Requirement R3.
