FERC Dismisses Complaint and Denies Request for Rulemaking

On December 2, 2015, in Docket No. EL15-93, FERC dismissed a complaint filed against NERC and SERC alleging a violation of NERC Rules of Procedure in assessing a penalty against Entergy Services, Inc. FERC noted that NERC and SERC were not subject to complaint under Section 306 of the Federal Power Act and, as such, dismissed the complaint. FERC also denied a related request for rulemaking requesting that the Commission order NERC to remove a provision of the Sanction Guidelines pertaining to settlement of compliance obligations.
