NERC Submits Comments on NOPR Regarding FERC Access to NERC Databases

On December 15, 2015, in Docket No. RM15-25, NERC provided comments on the FERC Notice of Proposed Rulemaking (NOPR) proposing to issue new regulation 18 C.F.R. §39.11(c) that would require NERC to provide FERC and its staff access to certain databases compiled and maintained by NERC. NERC’s comments propose an alternative to the methods for supplying this access in an effort continue to foster stakeholder engagement and participation in voluntary data sharing. NERC’s alternative would give FERC staff access to anonymized versions of the data sought in the NOPR under a two-phase process facilitated by a Commission and NERC staff Information Sharing Working Group overseen by senior management at both FERC and NERC and by the NERC Board of Trustees. The NOPR was released for comment on September 17, 2015.
