FERC Adjust Civil Monetary Penalty Amounts

On July 6, 2016, in Docket No. RM16-16, FERC issued an interim final rule to amend its regulations governing the maximum civil monetary penalties assessable for violations of statutes, rules, and orders within FERC’s jurisdiction.  FERC adjusted the amounts for inflation as required by the Federal Civil Penalties Inflation Adjustment Act of 2015.  The maximum civil penalty authority for a violation of Section 215 of the Federal Power Act (which derives its penalty authority under Section 316A) has been increased from $1,000,000 per violation per day to $1,193,970 per violation per day.
