FERC Issues Final Rule Revising FOIA Regulations

On November 17, 2016, in Docket No. RM17-5-000, FERC issued a final rule revising its FOIA regulations. The final rule was established pursuant to the Freedom of Information Act Improvement Act of 2016, signed on June 30, 2016. The Act requires agencies to revise their regulations within 180 days to account for the new statutory mandates. Additionally, the rule updates the delegation regulations with respect to determinations made by the General Counsel in response to FOIA administrative appeals.
