FERC Issues Order Denying Request for Rehearing of Order No. 833

On May 17, 2018, in Docket No. RM16-15-001, FERC issued an order denying the Edison Electric Institute's request for rehearing/clarification of Order No. 833. Order 833 amended the Commission's regulations to implement provisions of the Fixing America's Surface Transportation Act related to Critical Electric Infrastructure Information. EEI asserted the Commission erred or should reconsider certain aspects of Order No. 833. Although the Commission denied EEI’s request for rehearing, the Commission did clarify (1) sharing of Critical Energy/Electric Infrastructure Information (CEII), (2) CEII nondisclosure agreements (NDAs), and (3) designation of Commission-generated information.
