NERC and Texas RE Submit Motion for Extension of Compliance Filing Deadline

On October 21, 2021, in Docket No. RR21-3-000, NERC and Texas RE submitted a Motion for Extension of Compliance Filing Deadline in Response to the Order Conditionally Approving Texas RE Bylaws. On February 25, 2021, NERC and Texas RE filed a joint petition seeking approval of revisions to the Texas RE Bylaws. The proposed revisions revise one Article in the Bylaws to allow more flexibility in scheduling Texas RE’s annual meeting, and add one Article to specify governance procedures during an emergency. On October 7, 2021, the Commission issued an order conditionally approving the Bylaw revisions. In that order, the Commission directed NERC and Texas RE to file a compliance filing within 30 days (due November 8, 2021) to address an additional governance provision related to the approved Emergency Governance section. Specifically, the Commission directed that Texas RE include language to afford some degree of public notice of an emergency meeting conducted under the Emergency Governance Provisions. NERC and Texas RE request an extension of the compliance filing deadline to accommodate time needed to allow the Texas RE Board of Directors to approve an amendment to its Bylaws addressing FERC’s directive. Specifically, NERC requests that the Commission extend the deadline of the November Compliance Filing from November 8, 2021 to December 21, 2021.
