FERC Issues Final Rule Revising Definition of the Bulk Electric System

On November 18, 2010, in Docket No. RM09-18, FERC issued Order No. 743, which directed NERC to revise its definition of the bulk electric system (BES). Specifically, FERC directed NERC to revise the BES definition through the Reliability Standards Development Process to address FERC’s technical concerns. It clarified that FERC’s proposed 100kV threshold will not modify thresholds already established in individual reliability standards. Finally, FERC directs NERC to develop an exemption process whereby NERC would approve exemptions on a facility-by-facility basis, to be submitted to FERC within one year of the effective date of the Final Rule.
