FERC Grants Rehearing of July 12 Order Regarding CMEP and Revised Delegation Agreements

On December 1, 2010, in Docket Nos. RR10-7 and RR10-11, FERC granted the request for rehearing filed on August 6, 2010 by NERC, SERC, FRCC, and SPP regarding the Commission’s July 12, 2010 order, which accepted NERC’s proposed Compliance Monitoring and Enforcement Program (CMEP) agreements between SERC and SPP and between SERC and FRCC agreements, and associated revisions to the delegation agreements, subject to certain conditions. On March 20, 2010, NERC submitted a petition for approval of CMEP Agreements between SERC and SPP and between SERC and FRCC, providing that SERC will act as the Compliance Enforcement Authority for matters involving all registered entity functions for FRCC and SPP within their respective regions. NERC also submitted amendments to the associated Regional Entity Delegation Agreements to reflect these proposed CMEP Agreements.  FERC’s July 12 Order accepted these agreements subject to certain conditions.  On August 6, 2010, NERC and the regional entities requested rehearing of the conditions expressed in paragraph 25 of the Order addressing treatment of penalty monies.
