Steven Burns and Kenadi Mitchell Address Potential Implications of Sackett V. EPA in Article Published by Bloomberg Law

Steven Burns, partner in the firm’s Birmingham office and member of the Environmental & Natural Resources Practice, and Kenadi Mitchell, 2022 Balch Summer Associate and J.D. Candidate at Howard University School of Law, recently co-authored an article for Bloomberg Insights, published on July 20, 2022. 

In the article, Steven and Kenadi discuss several approaches SCOTUS may take in a case that could reshape how wetlands are defined under the Clean Water Act. Steven and Kenadi point out that all of the most likely pathways for the Court signal major changes for the wetlands program. Oral arguments in the case are set for Oct. 3, 2022. 
 
Steven advises clients on coal ash, waste and contamination, waterways, wildlife management, air and water quality, and natural resources. He serves as counsel and secretary to the National Waterways Conference, a trade association focused on water resource infrastructure, as well as chair of the association’s Legislative Policy Committee. 

Kenadi is a May 2024 Juris Doctorate candidate at the Howard University School of Law, and a 2022 Summer Associate at Balch.
