With more than 25 years of experience helping utility clients navigate complex regulatory issues, Lyle is deeply familiar with FERC procedures and precedent which positions him to develop successful approaches to managing FERC-related issues.

  • FERC Counsel: Serves as FERC regulatory counsel in mergers and acquisitions involving renewable power generation facilities, advises and works with market-based rate sellers concerning FERC markets regulation and tariff issues, and provides general representation both to one of the largest vertically integrated public utility and to one of the fastest growing independent power producers in the United States. (Ongoing)
  • Point-to-Point Transmission Rate Litigation:  Lead counsel to one of the largest point- to-point transmission system customers on the Midcontinent Independent System Operator (MISO) network in FERC investigation and compliant proceedings arising out of the integration of the Entergy electric system into MISO. (Ongoing)
  • Wind and Solar Generation Acquisition Counsel: Served as FERC regulatory due diligence and regulatory counsel for acquisition of wind and solar generation projects by joint venture of large utility system and equity investment fund. (Ongoing)
  • Regulatory Due Diligence for Wind Assets: Performed regulatory due diligence for acquisitions of wind resource assets in SPP by major independent power  producer. (Ongoing)
  • RTO/ISO Market Rules:  Served as RTO/ISO market rules and strategic counsel for independent power producer. (Ongoing)
  • RTEP Abandonment Cost Proceeding: Lead Counsel to PJM transmission owner group in largest RTEP abandonment cost recovery proceeding resolved to date. (2014)
  • Wholesale Power Consumers: Representation of major wholesale customers in Western power markets in connection with multi-billion dollar proceedings initiated by Federal and state authorities regarding alleged market manipulation. (2003 2013)
  • Wholesale Power Sellers: Representation of major Western power sellers in connection with Federal refund proceedings regarding California power markets. (2003 2013)
