About James
Captain Dawkins was well-known within our unit and was often sought out for consultation regarding numerous issues. He was very effective in the courtroom where trial personnel raved about his litigation skills and professional dedication.
Q&A
  • What do you see on the horizon in your area of practice?

    It is a significant transition to change practice areas from a military criminal practice to civil litigation, but if I have learned anything from my service, it is how to embrace and adapt to new challenges and changing landscapes. As a military prosecutor, being active in the courtroom is not just an expectation, it is a requirement. Consequently, my litigation opportunities were robust while I was on active duty, and I took advantage whenever I could because I enjoy the challenge and the exposure to new areas of the law. Even though moving to a civilian civil practice is a significant change, that challenge remains the same, only with opportunities to gain exposure to an even greater variety of practice areas and legal issues. I am excited to start this new chapter in my practice and cannot wait to leverage my unique experience and drive to learn in order to advance client objectives.

  • Obtained an eight-figure award on behalf of a multifamily residential developer in a complex construction defect arbitration.
  • Secured a favorable settlement for a multifamily property owner in a products liability suit against a national HVAC manufacturer.
  • Secured favorable settlement for general contractor against subcontractor for complex electronic systems that failed to operate as warranted.  
  • Defended a former employee accused of trade secret theft, resulting in a favorable settlement with no money paid out.
  • Drafted a motion to dismiss that resulted in an NPE’s patent being invalidated by the District Court, a decision upheld by the Court of Appeals for the Federal Circuit.
  • Defended the Alabama Department of Forensic Sciences from a patent infringement suit with no money paid out.
  • Successfully enforced a medical patent against an infringer, resulting in a total permanent halt of the infringing activities.
  • Secured highly favorable settlement from buyer and carrier for manufacturer whose goods were stolen en route to destination.  
  • Recovered unpaid invoices from international business on behalf of contractor in favorable settlement.   
  • Obtained a favorable settlement against a patent troll following the filing of a motion to dismiss seeking to invalidate the asserted patent for abstract subject matter.
  • Secure seven-figure settlement from former employee in trade secret theft and patent infringement suit
