  • What types of clients do you represent?

    I represent energy companies, with a principal focus on investor-owned electric utilities. 

  • Which courts or agencies do you most often appear before on behalf of your clients?

    I most frequently appear before the Federal Energy Regulatory Commission. As part of my practice, I also represent client interests before state public utility commissions, including the Alabama Public Service Commission.

  • Approval of certificate of convenience and necessity for power generation resources: Represented retail electric utility in its successful efforts to obtain PSC authorization to acquire existing combined cycle and combustion turbine generation; construct new combined cycle generation; and enter into a power purchase agreement for output from existing generation.
  • Defense of electric cost recovery tariff: Represented retail electric utility in litigation (PSC, FERC and federal district court) involving challenges to existing retail tariff authorizing cost recovery for back-up power service to partial requirements customers with on-site generation.
  • Representation and advocacy in interstate pipeline rate case: Represented electric utility shippers in major interstate pipeline Natural Gas Act section 4 rate cases.
  • Defense of fuel cost recovery tariff: Represented retail electric utility in litigation (PSC and state appellate courts) involving litigation over third-party challenges to practices surrounding existing retail fuel cost recovery tariff.
  • Representation and advocacy in interstate pipeline tariff dispute: Represented electric utility shippers in dispute over interstate pipeline tariff modification to install automatic cost recovery mechanism.
