With more than 25 years of experience helping utility clients navigate complex regulatory issues, Lyle is deeply familiar with FERC procedures and precedent which positions him to develop successful approaches to managing FERC-related issues.
  • What types of clients do you represent?

    My clients include traditional vertically integrated public utilities, unbundled RTO transmission owners, transmission providers, Federal State and local government-owned utilities, merchant generation asset managers, IPP and equity investment funds (passive and active investors).

  • What type of matters do you work on most often?

    The matters I work on most focus on FERC litigation and RTO matters, with emphasis on market-based rates, contested market design proceedings and merger authorizations.

  • FERC Counsel to Transmission Owner Coalition for Northeastern RTO: Serves as FERC and appellate counsel to a major coalition of RTO transmission owners, with emphasis on capacity, energy and ancillary services markets and buyer-side mitigation. The RTO involved is on the cutting edge of transforming the supply, transmission operations and demand side of the service delivery model in the region, including massive efforts to incorporate renewable and storage technologies into the resource mix.   • FERC Counsel: Serves as FERC regulatory counsel in asset acquisitions and divestiture transactions, mergers and acquisitions involving utility facilities, advises and works with market-based rate sellers concerning FERC markets regulation and tariff issues, and provides general representation both to one of the largest vertically integrated public utility and to one of the fastest growing independent power producers in the United States.   • FERC Litigation Regarding Congestion and Seams Management: Lead counsel to one of the largest point- to-point transmission system customers in the Midcontinent Independent System Operator (MISO) and the Southwest Power Pool (SPP) networks in active FERC proceedings arising. (Ongoing)
  • Renewable Generation Resource Acquisition Counsel: Served as FERC counsel for acquisition of wind and solar generation projects by multiple IPPS and project investment holding companies. (Ongoing)
  • Reactive Service Supply: Advised and serve as FERC counsel for various generators in organized markets regarding revenue requirements for reactive supply (Ongoing).
  • RTO/ISO Market Rules and Stakeholder Proceedings: Served as RTO/ISO market rules and strategic counsel for independent power producers for a coalition of transmission owners, and for a major investor-owned public utility holding company. (Ongoing)
  • PJM RTEP Abandonment Cost Proceeding: Lead Counsel to PJM transmission owner group in largest RTEP abandonment cost recovery proceeding resolved to date. (2014)
  • Wholesale Power Consumers: Representation of major wholesale customers in the Western Energy crisis litigation saga and related Enron bankruptcy (2008)
