  • What previous experiences, prior to your work at Balch, influence your practice?
    I have over thirty years of experience representing an array of regulated entities and individuals on a wide range of subjects before Texas administrative agencies and state and federal courts. I have particularly longstanding experience with utilities and gaming clients in Texas, and I am well-versed in how to challenge and defend agency rulings in the courts. I also have handled several cases involving property rights and jurisdictional issues for utilities in many of the Texas Courts of Appeal and the Texas Supreme Court. Through this work, I have developed a broad understanding of the utility industry and the challenges it faces both in Texas and neighboring regions. I am an especially skilled legal writer with a knack for distilling, organizing, and explaining complex concepts effectively and persuasively.
  • What types of matters do you work on most often?
    I have focused most recently on property rights and jurisdictional disputes involving regulated utilities charged with meeting the rapidly growing demand for reliable electric service in Texas.

  • Scope of easement holder's rights: Successfully represented electric utility in dispute over scope of utility's right to upgrade facilities on easement that did not specify materials or spatial boundaries.
  • Just and reasonable rates: Successfully represented group of public utilities in appeal of FERC order concerning compliance with cost-causation principle and Federal Power Act.
  • Scope of easement: Successfully represented electric utility in dispute over scope of utility's right to use easement that did not specify spatial limitations.
  • General contractor liability for subcontractor negligence: Successfully represented electric utility in dispute over scope of liability for premises liability claim involving condition created by subcontractors.
